GENERAL SALES CONDITIONS

Article 1: Fields of Application and Modification of the General Conditions of Sale. These terms and conditions apply to all orders placed online on this website, Archisoft Group reserves the right to adapt or modify these terms and conditions at any time. In case of modification, it will be applied to each order the general conditions of sale in force on the day of the order.

Article 2: Availability of products - Our offers of products and prices are valid as long as they are visible on the site, within the limit of available stocks. Upon receipt of your order, we check the availability of the product(s) ordered. In case of unavailability, we commit within 30 days from the validation of the order to either deliver the ordered product to you or to refund it to you. - In case of out of stock on one of the products of your order: we ship the rest of your order.

Article 3: Acceptance of the offer - By your order, you acknowledge that you have the full legal capacity to undertake under these general conditions of sale. You will receive by email a confirmation of your order which will include the components. Our computer records, kept under reasonable security conditions, will provide proof of communications, orders and payments. We archive purchase orders and invoices on a reliable and durable medium, which can be legally produced as proof.

Article 4: Prices - Archisoft Group reserves the right to change its prices at any time but undertakes to apply the prices in force which have been indicated to you at the time of your order, subject to availability on this date.

Article 5: Payment and Security Terms - Payment Terms. You can make the payment by credit card. Payment is made on the secure server of our partner Cybermut (Credit mutuel). This implies that no banking information concerning you passes through the Archisoft Group website. Payment by credit card is therefore perfectly secure; your order will be recorded and validated as soon as the bank accepts the payment. - Security: Your credit card details are encrypted using the Secure Socket Layer (SSL) protocol and never clear through the network. Payment is made directly to the bank. Archisoft Group has no access to these coordinates, and does not keep them on its servers. This is why they are requested from you every time a new transaction is made on our site. - Retention of title clause: The products remain the property of Archisoft Group until the full collection of the order by Archisoft Group. However, from delivery, the risks of the delivered goods are transferred to the customer. - Default of Payment: Archisoft Group reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially settled a previous order or with whom a payment dispute is being administered.

Article 6: Delivery methods and delivery times - Archisoft Group delivers to Metropolitan France, the DOM, the European Union and certain other countries of the world. In case your country is not listed, please contact us. General: The products are delivered to the delivery address you have indicated during the ordering process. Costs: The cost of participating in the preparation and shipping of the order depends on the place of delivery and the amount of the order, for all orders placed on the Archisoft Group site but for some products, these costs may be offered. In this case, a notification clearly states the conditions of the offer on the product sheet. 6.2 Delivery method: Archisoft Group delivers all your orders by post in Colissimo Expert tracking, delivery against signature.
Delivery time: Your order will be delivered within the time specified below:
1. delivery in mainland France: 2 days (indicative time)
2. delivery in the DOM: 5 to 7 days (indicative period)
3. delivery in Europe (countries mentioned above): 4 to 8 days (indicative time)
4. delivery to the rest of the world: may take more than 8 days (indicative time)
5. Notes: 1. Delivery will depend on the bank verification required for the process to work. In case of delay, we will do our best to contact you by phone, fax, letter or e-mail. 2. All advertised deadlines are calculated in business days. Damaged packages: If at the time of delivery, the original packaging is damaged, torn, opened, you must check the condition of the items. If they have been damaged, we invite you to refuse the parcel and note a reservation on the delivery note (parcel refused because opened or damaged). 3. Due to COVID-19, delivery times may be greater than those generally used. The time limits provided in these general conditions are given only as an indication. In case of longer than expected delivery time, Archisoft Group cannot be held responsible.

Article 7: Responsibilities - Archisoft Group shall not be held responsible for the non-performance of the contract entered into on the occasion of force majeure, disruption or total or partial strike, in particular postal services and means of transport and/or communications, flood, fire. With regard to products purchased to satisfy professional needs, Archisoft Group will not incur any liability for any indirect damages arising from the foregoing, loss of use, loss of profit, damage or costs, which may arise. - The choice and purchase of a product or service is the sole responsibility of the customer. The total or partial impossibility of using the products in particular because of incompatibility of the material may not give rise to any compensation, refund or questioning of the responsibility of Archisoft Group, except in the case of a proven hidden defect, non-compliance, defect or exercise of the right of withdrawal contemplated under Article 8. In case of hidden defect, you have the choice between cancelling the order or keeping the product against a price decrease. - In case of non-delivery of an order or part of an order, you have a maximum of two months (from the date of departure of our warehouses) to express yourself. Beyond this deadline, we will not accept any claims.

Article 8: Right of withdrawal - In accordance with article L.121-20 et seq of the French Consumer Code, the consumer has a period of 14 days from the date of delivery of his order, including in the case of a credit purchase to inform Archisoft Group of its intention to withdraw to return any item unsuitable for it and request the exchange or refund without penalty, with the exception of the return fee. The product must be returned in good condition, accompanied by all accessories in its original packaging, and not used (product scratched or broken) and this within 14 days of sending the decision to withdraw. This right to return applies only to products purchased from Metropolitan France and only by mail order. The costs of return in case of withdrawal remain at the customer’s expense. In case of withdrawal in store, the right of withdrawal cannot apply because the sale will not take place online but directly in store, the payment being validated only when the product is handed over to the customer. Internet booking is not considered a mail order. During collection and before purchase, the customer can request a hardware test in store of the product reference reserved in exhibition. In case of product dissatisfaction, the customer can decide at any time to cancel his reservation but only before the product is withdrawn. The date of the withdrawal is served by the customer’s dated signature upon its withdrawal on the duplicate of the purchase invoice. No withdrawal can be made without the customer’s signature. The right of withdrawal applies only to individuals and is not valid for companies. Groupe Archisoft reserves the right to verify the identity of the customer on proof of identity (passport, identity card, driver’s license). In the case of the product removal of a third person, a proof of identity of the customer may be requested. In the event of failure to submit supporting documents, Archisoft Group reserves the right to cancel the sale. In the event of a cancellation of the sale, the full refund of the sums paid will be made within 14 days of receipt of the request for withdrawal of the article concerned. However, the repayment period may be extended until the date of recovery of the goods or until the consumer has provided proof of the shipment of the goods. In accordance with the "Code de la consommation: articles L121-21 to L121-21-8: Right of withdrawal applicable to contracts concluded at a distance", in the event of a dispute with Archisoft Group, it is up to the consumer to prove that he has complied with the withdrawal period. 8.1 - Noncompliance: In accordance with sections L.211-1 to L212-1 of the Consumer Code, the consumer has three options in the event of non-compliance: repair, replacement or refund. 8.2 - Hidden defect, defect: In case of hidden defect of which Archisoft Group was unaware the defects, or of defect and this for a period of 2 years, the costs caused by the sale will be the subject of a refund if these are proven by the consumer. 8.3 - Withdrawal of 60 days: Some products have a right of withdrawal of 60 days instead of 14 days following the sending of the decision to withdraw. This exceptional withdrawal period is limited to one return per customer. In the case of a second referral, the time limit will be limited to 14 days as provided for in the consumer code. 8.4 - In case of sale outside the European Union, local taxes charged to the customer may apply.


ATTENTION: the right of withdrawal is very strict.


- Only individuals have the right of withdrawal. If you registered a business billing address at the time of your order, you do not have this right.
- You have the right to unpack your product, plug it in to make sure it is working properly, BUT YOU DON’T HAVE THE RIGHT TO USE IT.
- The product must be returned to us COMPLETE, CLEAN, WELL PACKAGED. If you have damaged the original packaging at the opening (cardboard excessively torn for example), if the appearance of the product is damaged or scratched or if an accessory is missing, THE RETURN WILL BE REFUSED.
- If you add tape to the original product box, RETURN WILL BE REFUSED.

- If the product complies with all its instructions, but it arrives deteriorated at our premises, YOU ARE RESPONSIBLE and the return WILL BE REFUSED.

Article 9: Provisions of the law «Informatique et libertés» - At any time, you have the right to access, modify, rectify and delete the data that concern you (art 34 of the law «Informatique et Libertés» of 6 January 1978). When ordering, we offer you to receive information and offers. If you wish to receive them, simply tick the following sentence: I wish to receive the Archisoft Group newsletter. You can also change your subscription by emailing groupe.archisoft@me.com.

Article 10 : Commercial guarantee - Unless otherwise indicated, the commercial warranty on Archisoft Group products is 1 year (parts and labour). In accordance with the current European law in force, the duration of the commercial guarantee is defined by the retailer - the guarantee indicated on the invoice being taken as proof. It includes the costs of returns but the shipping costs are the responsibility of the consumer. For any return of a product under warranty, the consumer must send an email to groupe.archisoft@me.com. A return form to be completed will then be returned to the consumer. The consumer also has legal rights. The commercial guarantee does not preclude the rights linked to the legal guarantee of conformity linked to the contract.

Second-hand products

The warranty applies to second-hand products as well as new products. The warranty period is 6 months from the date of purchase.

After sales service

Products ordered on magnetar.store are shipped from France. In the case of a repair of a product validated by Magnetar, the product must be returned to the shipping address based in France : Groupe Archisoft / Magnetar, 66 Boulevard Malesherbes, 75008 Paris, France

Customs and import duties

As part of the shipment of an order to a country other than France or a member country of the European Union, you remain the importer of the product(s) concerned. Any customs duties, other local taxes, import duties or state taxes that may be required (including carrier handling charges) will not be the responsibility of Magnetar. It is your sole responsibility to check with your local authorities and take responsibility for the corresponding declarations and payments with the competent authorities and organizations of the country concerned.
